On June 19, 2018, the Supreme Court will hold a hearing to address The Supreme Court Advisory Committee on the Rules of Evidence’s recommendation of amendments to rules 404, 702, and 1101 of the Rules of Evidence as well as its recommendations on the adoption of a new rule, 502, to govern disclosures covered by the attorney-client or work product privileges. Mark Fredrickson (Lind, Jensen, Sullivan & Peterson, P.A.), a past president of MDLA and the current DRI State Representative will, on behalf of the Minnesota Defense Lawyers Association, DRI-The Voice of the Defense Bar, and the Federation of Defense & Corporate Counsel, present comments on Rule 702 in support of an amendment adopting the Daubert standard for admissibility of expert testimony. A letter supporting this position was filed by the vast majority of the national civil defense organizations and MDLA. These organizations did not comment on the Committee’s recommendations regarding the other proposed recommendations.
